Terms of Service

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.

Your account

• You’re responsible for the information you provide and for activity under your account.
• Keep your login credentials secure; notify us promptly of any unauthorized use.
• Provide accurate information (including any DUPR rating you enter manually) and keep it current.
• You may delete your account at any time from the app’s settings.

Acceptable use

You agree not to:

• Break the law, infringe others’ rights, or post abusive, harassing, or misleading content.
• Impersonate another person or misrepresent your identity, affiliation, or rating.
• Scrape, harvest, or bulk-collect data, or access the Service through automated means without permission.
• Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its systems.
• Reverse engineer or attempt to extract source code except where permitted by law.

Your content

You retain ownership of the content you submit — sessions, posts, goals, and similar. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it as needed to operate and provide the Service (for example, showing your activity on the leaderboard, feed, and your public profile, consistent with your privacy settings). You’re responsible for the content you post and represent that you have the rights to share it.

DUPR and third-party services

The Service integrates third-party services, including DUPR (for rating data) and Google and Apple (for sign-in). Your use of those services is subject to their own terms and privacy policies. DUPR ratings, history, and related data are provided by DUPR; we display them as received and don’t guarantee their accuracy, availability, or timeliness. We are not responsible for third-party services and may change or remove integrations at any time.

Service changes and availability

We’re actively developing the Service and may add, change, suspend, or discontinue features at any time. We don’t guarantee the Service will always be available, uninterrupted, or error-free.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or any data (including DUPR ratings) is accurate, reliable, or complete. The Service is for informational and recreational use and is not athletic, medical, or professional advice.

Limitation of liability

To the fullest extent permitted by law, Holbrook Pickleball and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Where liability cannot be excluded, it is limited to the greatest extent permitted by law.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (such as content licenses already exercised, disclaimers, and limitations of liability) will survive.

Governing law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-laws rules. Any disputes will be subject to the courts located there, unless applicable law requires otherwise.

Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above, and material changes may be communicated through the Service. Your continued use after changes take effect means you accept the updated Terms.
